國際貿(mào)易中如何起草有效的仲裁條款

國際貿(mào)易中，一般在爭議解決條款中都會涉及仲裁條款，然而在有些時候，

因為某些原因，看似約定仲裁，實際仲裁條款是無效的，使得一方（尤其是中方）

維權(quán)成本大大增減，甚至有時自認倒霉，放棄維權(quán)。一下兩則仲裁條款，

均來源于中國國際經(jīng)濟貿(mào)易仲裁委員會起草的示范條款，以供參考。

示范仲裁條款（一）

凡因本合同引起的或與本合同有關(guān)的任何爭議，均應(yīng)提交中國國際經(jīng)濟貿(mào)易仲裁委員

會，按照申請仲裁時該會現(xiàn)行有效的仲裁規(guī)則進行仲裁。仲裁裁決是終局的，對雙

方均有約束力。

Any dispute arising from or in connection with this Contract shall be

 submitted to China International Economic and Trade Arbitration 

Commission(CIETAC)for arbitration which shall be conducted in

 accordance with the CIETAC`s arbitration rules in effect at the 

time of applying for arbitration.The arbitral award is final and

 binding upon both parties.

示范仲裁條款（二）

凡因本合同引起的或與本合同有關(guān)的任何爭議，均應(yīng)提交中國國際經(jīng)濟貿(mào)易

仲裁委員會 分會（仲裁中心），按照仲裁申請時中國國際經(jīng)濟貿(mào)易仲裁委員

會現(xiàn)行有效的仲裁規(guī)則進行仲裁。仲裁裁決是終局的，對雙方均有約束力。
